6. Payment Terms
6.1 Pricing
All prices for food items, delivery fees, and any applicable service charges are displayed on our Site in United States Dollars (USD). Prices are subject to change at our discretion without prior notice. The price displayed at the time you complete and submit your order will be the price charged, subject to any applicable taxes and fees.
6.2 Payment Methods

6.5 Refunds and Cancellations
Orders may be cancelled before preparation has begun. Once an order has been accepted and preparation has commenced, cancellations may not be possible. Refunds or credits are issued at our sole discretion, on a case-by-case basis. Chargebacks initiated without first contacting us may result in suspension of your account.
7. Intellectual Property Rights

You represent and warrant that you own or have the necessary rights to grant this license and that your User Content does not infringe any third-party rights.
8. Food Allergen and Dietary Information
Dewey's Pizza makes reasonable efforts to provide accurate allergen and ingredient information on its menu. However, our food is prepared in a shared kitchen environment where cross-contamination with allergens, including but not limited to gluten, dairy, nuts, eggs, soy, and shellfish, is possible. We cannot guarantee that any item is completely free from any allergen.
Customers with known food allergies, dietary restrictions, or medical dietary requirements are strongly encouraged to contact us directly before placing an order to discuss their specific needs. Dewey's Pizza shall not be held liable for any adverse reactions resulting from allergen exposure where the customer has failed to disclose relevant dietary information prior to ordering.
9. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Dewey's Pizza expressly disclaims all warranties, including but not limited to:
- Any implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Any warranties regarding the accuracy, reliability, timeliness, or completeness of any information on the Site;
- Any warranties that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components;
- Any warranties that defects or errors will be corrected; and
- Any warranties regarding the quality, safety, or suitability of food products ordered through the Site.
Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the foregoing exclusions shall apply to the fullest extent permitted by applicable law.
10. Limitation of Liability
This limitation applies regardless of the legal theory under which damages are sought (whether in contract, tort, negligence, strict liability, or otherwise), even if Dewey's Pizza has been advised of the possibility of such damages. This includes, without limitation:
- Loss of revenue, profits, or anticipated savings;
- Loss of data, use, or goodwill;
- Business interruption;
- Personal injury or property damage resulting from your use of or inability to use the Site or services;
- Any unauthorized access to or alteration of your data or transmissions; or
- Any errors or omissions in any content on the Site.
In no event shall Dewey's Pizza's total cumulative liability to you for any and all claims arising from or related to these Terms, the Site, or the services exceed the greater of: (a) the total amount paid by you to Dewey's Pizza in the three (3) months immediately preceding the event giving rise to the claim; or (b) One Hundred United States Dollars ($100.00).
The limitations set forth in this section shall apply to the fullest extent permitted by applicable United States law, including the consumer protection standards established under the Federal Trade Commission Act (15 U.S.C. § 45 et seq.).
11. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza, its owners, directors, officers, employees, agents, contractors, licensors, and successors (collectively, "Indemnified Parties") from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or in connection with:
- Your access to or use of the Site or services;
- Any breach or alleged breach of these Terms by you;
- Any violation of applicable law or regulation by you;
- Any User Content you submit to the Site;
- Your infringement or alleged infringement of any third-party intellectual property, privacy, or other rights; or
- Any misrepresentation made by you in connection with your use of our services.
Dewey's Pizza reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any such matter without our prior written consent.

14. Governing Law and Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms, the Site, or the services shall be brought exclusively in the federal or state courts of competent jurisdiction located within the United States. You hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection to the laying of venue in such courts.
Notwithstanding the foregoing, Dewey's Pizza reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.
15. Dispute Resolution
15.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the services informally by contacting Dewey's Pizza at [email protected] with a written description of the dispute and your desired resolution. We will attempt to resolve the dispute within thirty (30) days of receiving your notice. If the dispute is not resolved within that period, either party may pursue the remedies available under these Terms.
15.2 Binding Arbitration
Subject to the exceptions set forth herein, you and Dewey's Pizza agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the Site or services, shall be resolved by final and binding arbitration. The arbitration shall be conducted in English, in accordance with the rules of a recognized arbitration organization, and the arbitrator's decision shall be final and binding on the parties.
15.3 Class Action Waiver
YOU AND DEWEY'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. No arbitration or legal proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated or litigated on a class-action basis or to utilize class-action procedures. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of class or representative proceeding.
15.4 Exceptions to Arbitration
Notwithstanding the above, either party may seek emergency injunctive relief or other equitable relief in a court of law to prevent imminent harm, protect intellectual property rights, or enforce the confidentiality obligations in these Terms, without waiving the right to arbitrate all other claims.
16. Term and Termination
16.1 Term
These Terms shall remain in full force and effect for as long as you use the Site or services, or maintain an account with Dewey's Pizza.
16.2 Termination by You
You may terminate these Terms at any time by discontinuing your use of the Site, cancelling any active account, and refraining from placing further orders.
16.3 Termination by Dewey's Pizza
We reserve the right, in our sole and absolute discretion, to suspend or terminate your access to the Site or your account, or to cancel pending orders, at any time and for any reason or no reason, with or without prior notice, including but not limited to:
- Violation of any provision of these Terms;
- Fraud, misrepresentation, or unlawful activity;
- Conduct that we believe is harmful to other users, third parties, or our business interests; or
- Our decision to discontinue or modify the Site or services.
16.4 Effect of Termination
Upon termination, all licenses and rights granted to you under these Terms shall immediately cease. Any provisions of these Terms that by their nature should survive termination (including, without limitation, intellectual property provisions, disclaimers of warranty, limitations of liability, indemnification, governing law, and dispute resolution) shall survive termination.
17. Changes to These Terms
Dewey's Pizza reserves the right to modify, update, or revise these Terms of Service at any time in our sole discretion. 18. Severability

21. Force Majeure
Dewey's Pizza shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, pandemic, epidemic, governmental action or restriction, labor disputes, power failures, internet outages, supply chain disruptions, acts of terrorism, or civil unrest ("Force Majeure Event"). In the event of a Force Majeure Event, Dewey's Pizza will use commercially reasonable efforts to resume its services as soon as practicable.
22. Electronic Communications and Consent
By using our Site and providing your email address or phone number, you consent to receive electronic communications from Dewey's Pizza, including order confirmations, receipts, customer service communications, promotional offers, and policy updates.
